Abstract
澳門《聘用外地僱員法》確立的補充原則、報酬平等原則及優先原則,因實現機制的內生缺陷而面臨系統性功能失效。首先,行政許可制度下,審查部門受限於行政資源的約束與勞動市場的信息不對稱,難以實質核驗企業申報的“本地招聘困難”證明,致使補充原則在實踐中趨於形式化;其次,現行統一的聘用費標準顯著低於本地與外地僱員的實際薪資差額,未能有效內化企業替代性用工的社會成本,反而形成負向激勵,誘發聘用實體利用低廉勞動力成本套利,進而擠佔本地就業空間。破解困局需構建“經濟槓桿”與“行政基準”並行的雙軌規制路徑:其一,健全差異化費率機制,參照新加坡外地僱員稅制度,構建涵蓋產業類別、職位層級及外地僱員佔比的三維調節模型,通過動態費率抬升替代成本;其二,引入工資中位數標準,借鑑香港“補充勞工優化計劃”的經驗,強制要求外地僱員薪酬不低於本地相類職位的工資中位數,壓縮薪資套利空間。

The principles of complementarity, remuneration equality, and priority enshrined in Macao’s Employment of Non-Resident Workers Law are currently confronting systemic functional failures, primarily attributable to endogenous flaws within their implementation mechanisms. First, under the administrative licensing regime, regulatory authorities are constrained by limited administrative resources and information asymmetry within the labour market. This renders the substantive verification of “local recruitment difficulties” claimed by employers arduous, thereby gradually reducing the complementarity principle to a largely formalistic notion in practice. Second, the current uniform hiring fee remains significantly lower than the actual wage differential between local and non-resident workers. This discrepancy fails to internalize the social costs associated with labour substitution, instead creating an inadvertent incentive for employers to engage in labour cost arbitrage. To resolve these dilemmas, it requires a dual-track regulatory framework that combines “economic leverage” and “administrative benchmarks”: (1) establishing a differentiated levy mechanism by drawing on Singapore’s foreign worker levy, which is essentially a pricing tool and used to dynamically moderate substitution costs; and (2) introducing a median wage benchmark – based on Hong Kong’s Enhanced Supplementary Labour Scheme – to mandate that non-resident workers must be paid no less than the median monthly wages of local workers in comparable positions.
