Abstract
澳葡政府為攏絡華人富商,擴大殖民管治認受性,於1909年頒佈《澳門華人習俗條例》,以中國宗法制度為本,規範華人的婚姻和遺產繼承,包括容許華人納妾。抗戰勝利後,澳門中華婦女會向澳葡政府提出修訂《華人習俗條例》,以符合當時男女平等、一夫一妻的中國法律。中華婦女會避開敏感的廢除納妾話題,在公開演講及訴求呈請中,均以爭取平等繼承權作主要陳述。澳葡政府最終在1948年頒佈新法例,容許華人依中國新《民法》安排婚姻和遺產繼承。

In order to attract wealthy Chinese merchants to stay in Macao and to expand the recognition of colonial governance, the Macao Portuguese government promulgated the Code of Chinese Customs and Uses (Código dos Usos e Costumes Chineses) in 1909, which was based on the Chinese patriarchal system to regulate Chinese marriage and inheritance, including allowing concubinage. After the victory of the AntiJapanese War, the Macao Chinese Ladies Association (Associação das Senhoras Chinesas de Macau, ASCM) proposed to the government to amend the Code to conform to the then Chinese law of gender equality and monogamy. During the campaign, the ASCM refrained from mentioning the sensitive issue of abolishing concubinage, and in its public speeches and petitions, it focused on the fight for equal inheritance rights. The Macao Portuguese government eventually enacted a new legislation in 1948, which provided that Chinese people’s marital arrangements and inheritance could be made in accordance with China’s Civil Code.
