作為中國境內並行的兩部大陸法系民法典，《中國民法典》與澳門《民法典》的制定有着各自不同的時代背景，二者都體現了鮮明的時代特色。前者經百年積澱、有序漸進而厚積薄發，既立足實踐又關注未來；後者直接承繼葡萄牙《民法典》，在立法上漢語與葡萄牙語並行，持續發展調整適應澳門社會。比較兩部民法典的精神氣質和體系特徵，既為橫琴粵澳深度合作區民商事法律規則的銜接和融合奠定基礎，亦為兩部法典的未來提供新的活力與思路。
As two parallel civil codes of civil law systems in China, the Chinese Civil Code and the Macao Código Civil were formulated against different backgrounds of their respective times, and both embody distinctive characteristics of the times. The former has been built up over the past hundred years and has been developed in an orderly and progressive manner, based on both practice and concern for the future; the latter is directly inherited from the Portuguese Código Civil, and in terms of legislation, the Chinese language and the Portuguese language go hand in hand, with continuous development and adjustment to adapt to the Macao society. Comparing the spirit and system characteristics of the two civil codes will lay the foundation for the convergence and integration of the civil and commercial legal rules of the Guangdong-Macao Deep Co-operation Zone in Hengqin, and provide new vitality and ideas for the future of the two codes. |
