澳門警察職權行使問題評析──以公共場所查證身份為例

Macao Unitary Police Service, which is affiliated to Macao Security Bureau, can be divided into two departments, i.e. Public Security Police Force and Judiciary Police. For crime prevention, the two departments both have the authority to verify people’s identities. However, as to how they can exercise such authority specifically in public places, there is no specific law or regulation that can be referred to. Among current laws and regulations, only a few provisions, provided in ‘Lei de Bases da Segurança Interna da Região Administrativa Especial de Macau’ and ‘Código de Processo Penal’, are applicable. However, whether these provisions are appropriate is still an issue requiring further discussions. Nevertheless, only these independent provisions conferring such authority on police are not adequate. In order to effectively protect people’s fundamental rights, specific laws defining the scope of the power of the police are necessary.
