Abstract
在澳門立法會選舉中“選票自拍禁令”的合憲性問題上,防止賄選的確是一項令人信服的目的,也是值得保護的迫切的公共利益,但是禁止選票自拍這一手段與防止賄選這一目的之間可能並不存在想像中的匹配關係。實施這一手段的絕大部分甚至全部效果是限制選民的言論自由等正當權利。如果只要規定“買賣選票為非法”即能達到防止賄選的目的,政府就不應過於輕易地為了效率而犧牲自由。鑑於未採取選票自拍禁令的地區也並未出現選票照片買賣市場,特區政府在這個問題上應更加理性。

This article analyzes the constitutionality of the ballot-selfie prohibition in Macao Legislative Assembly Election. The author thinks that prevention of vote buying is indeed a convincing legitimate purpose, and a compelling public interest worthy of protection. Nevertheless, there is a substantial mismatch between the means of ballot-selfie prohibition and its objective of vote-buying prevention. Actually, the major or even the full effect of this means is only to restrict voters’ important legitimate rights, such as freedom of speech. If it is adequate to prevent vote buying by simply making it unlawful to use an image of a completed ballot, the government then should not too readily sacrifice voters’ liberty for efficiency. Given the fact that no such vote-selling market has emerged in jurisdictions where do not have ballot-selfie prohibition, Macao government should be more rational on this matter. The prohibition is likely to excessively restrict voters’ liberty yet yield no practical results. Without concrete evidence, the government should not adopt means of this sort based merely on conjecture.
