澳門特區立法會議事規則：性質、效力與價值

The enactment and implementation of the rules of procedure is the reflection of the high degree of autonomy, which is granted to the Legislative Assembly of Macau Special Administrative Region from the Macau Basic Law. By nature, the Rules of Procedure have the attributes of parliamentary law and empowerment law. It only adjusts the power and obligation relationship within the Legislative Assembly and is binding on it. In terms of effectiveness, the Rules of Procedure must not contravene the Macau Basic Law. It includes not being in conflict with the terms, principles, and spirit of the Basic Law and it must not violate the legitimacy of the procedure. The court of SAR should exercise restraint when it comes to adjudicating the internal affairs of the Legislative Assembly. The Standing Committee of the National People’s Congress should review the Rules of Procedure in accordance with the principle of functionalism. From the perspective of value, the enactment and implementation of the Rules of Procedure need to maintain the unity of freedom and order and ensure the legitimacy of the behavior of legislators.
