由於粵港澳大灣區在政策、法律法規、文化等方面存在差異，三地居民的醫療康養資料並不互通，對居民生活以及大灣區的資料跨境造成了一定的障礙。本文以醫療康養數據為例，從境內外法律法規、使用倫理及技術難點三方面展關研究。針對醫療康養數據的跨境需求，本文提出相應的策和建議條文，為打造大灣區一體化建設提供具有價值的參考依據，也為日後中國與國際的數據跨境流通帶來借鑑意義。 With the rapid economic development of the Guangdong-Hong Kong-Macao Greater Bay Area, the links between the Mainland of China, the Hong Kong Special Administrative Region and the Macao Special Administrative Region have become increasingly close. Cross-border medical data is an important issue for data sharing and win-win cooperation between the three places. Due to the differences in policies, laws and regulations, culture and other aspects in the Guangdong-Hong Kong-Macao Greater Bay Area, the medical and health information of residents in the three places is not interoperable, which has caused certain obstacles to the life of residents and the cross-border information of the Greater Bay Area. Taking the data of medical health care as an example, this paper conducts research from three aspects: domestic and foreign laws and regulations, use of ethics and technical difficulties. Given the cross-border demand for medical health data, this paper puts forward corresponding strategies and suggestions, which provide valuable reference for the construction of the integration of the Greater Bay Area, and also bring great significance for the cross-border circulation of data between China and the international in the future. |
