本文主要探討了澳門同善堂成立前後的歷史背景和相關法律規範,特別考證了澳葡時期的“人情紙”的應用以及其關聯的華人社會事件︒本文發現,過往較少為研究者注意的“人情紙”,自1875年已用於港口管理,後被擴展至民生事務的許可上,與“票據”和“牌照”等官方許可文件一樣均用於指代葡語licença︒1892年澳葡當局推行米酒專營,引致全澳華人大罷市後,當局將“人情紙”視同許可集會的正式官方文件,要求華人舉辦活動前要向華政衙門申領︒1892年12月1日同善堂通過章程正式成立,但其從成立到正式獲得官方許可的過程中,需要遵循葡萄牙當局制定的法律規範,從中可見澳葡當局如何透過法律移植以及藉尊重華人風俗的名義,將日益壯大的華人社群納入正規管理之中︒

This article explores the historical background and related legal norms before and after the establishment of the Macao Tung Sin Tong. Tung Sin Tong is a significant Chinese charitable organization in Macao’s history, founded on December 1, 1892. Its establishment process had to adhere to the legal regulations set by the Portuguese authorities, including using “Renqing Paper” to obtain assembly rights. These legal regulations are based on the Portuguese Civil Code approved in 1867, with added provisions respecting Chinese customs in the later years, resulting in localized regulations. This integration enabled the growing Chinese community to be included in the formal management system and provided legal legitimacy for the Macao-Portuguese authorities’ governance of Macao’s organizations. This study also reveals that the previously less-examined “Renqing Paper” had been utilized for port management since 1875 and later extended to permissions for civil affairs. It is used to refer to the Portuguese word licença, as are other official permit documents such as “notes” and “licenses”. In 1892, following the implementation of the rice wine monopoly by the Macao-Portuguese authorities, which led to a large-scale strike among the Chinese community in Macao, the authorities treated the “Renqing Paper” as an official document granting assembly permission. They required Chinese event organizers to apply for it from the Chinese Affairs Police Office.
